Pro se plaintiff Peter Strojnik, a resident of Arizona, alleges that defendant’s hotel, the Monte Cristo Inn B&B (“Monte Cristo”) in San Francisco, California, violated his rights of equal access under the Americans with Disabilities Act (“ADA”), the California Unruh Civil Rights Act (“Unruh”), and the California Disabled Persons Act (“DPA”). Dkt. No. 1. He also sues for negligence per se. Id. Monte Cristo filed an oversize motion to dismiss for lack of subject matter jurisdiction under Federal Rule of Civil Procedure 12(b)(1), and failure to state a claim under Rule 12(b)(6). Dkt. No. 7.
