12 Petitioner Claude Bent is a noncitizen from Jamaica who is currently in Immigration and 13 Customs Enforcement (“ICE”) custody pending the conclusion of his removal proceedings. On 14 September 26, 2019, Bent filed a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241 in 15 which he asks the court to order his release from custody or to direct the United States Department 16 of Justice Executive Office for Immigration Review (“EOIR”) to provide him with an individualized 17 custody hearing. [Docket No. 1 (“Petition”).] He also filed a motion for a temporary restraining 18 order (“TRO”) seeking to enjoin his continued detention without a custody hearing until the court 19 decides his habeas petition.
