Petitioner Claude Bent is a noncitizen from Jamaica who is currently in Immigration and Customs Enforcement (“ICE”) custody pending the conclusion of his removal proceedings. On September 26, 2019, Bent filed a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241 in which he asks the court to order his release from custody or to direct the United States Department of Justice Executive Office for Immigration Review (“EOIR”) to provide him with an individualized custody hearing. [Docket No. 1 (“Petition”).] He also filed a motion for a temporary restraining order (“TRO”) seeking to enjoin his continued detention without a custody hearing until the court decides his habeas petition.
