14 15 On March 16, 2020, Defendant RIHH LP filed the instant motion to dismiss plaintiff’s first 16 amended complaint (“FAC”) for lack of jurisdiction and failure to state a claim. Dkt. No. 17 (Motion 17 to Dismiss). Pursuant to Civil Local Rule 7-1(b) the Court hereby vacates the April 17, 2020, 18 hearing. The motion to dismiss is hereby DENIED. 19 20 BACKGROUND 21 The background of this case is discussed in the Court’s February 18, 2020 order granting in 22 part and denying in part defendant’s motion to dismiss. See Dkt. No. 11 (Order on Motion to 23 Dismiss).
