11 12 Plaintiff Finjan, Inc. (“Finjan”) brings this patent infringement action against defendant 13 Qualys Inc. (“Qualys”) for direct and indirect infringement of six of its patents. (Dkt. No. 1 14 (“Complaint”).) Now before the Court is Qualys’ motion for leave to amend its answer to add 15 patent exhaustion, implied license, and preclusion as affirmative defenses. (Dkt. No. 44 (“Mot.”).) 16 Having carefully considered the pleadings and the papers submitted,1 the Court GRANTS Qualys’ 17 motion for leave to amend. 18 I.
