13 Defendant Ghirardelli Chocolate Co.’s (“Ghirardelli” or “defendant”) motion to dismiss came on for hearing before this court on March 11, 2020. Plaintiffs Linda Cheslow and Steven Prescott (“plaintiffs”) appeared through their counsel, Matthew Theriault. Defendant appeared through its counsel, Dale Giali. Having read the papers filed by the parties and carefully considered their arguments and relevant authority, and good cause appearing, the court hereby GRANTS defendant’s motion for the following reasons.
