12 Petitioner Claude Bent is a foreign national detained in Mesa Verde ICE Processing Facility 13 (“Mesa Verde”), which is located in Kern County, California. Before the court is Bent’s motion for 14 a temporary restraining order (“TRO”) seeking immediate release from detention because of the 15 COVID-19 pandemic. [Docket Nos. 20 (“Mot.”), 23 (“Reply”).] Respondents oppose. [Docket 16 No. 22 (“Opp.”).] For the reasons stated below, the petition is conditionally granted. 17 I. BACKGROUND 18 A.
