This is a product liability action. Plaintiff Joseph North (“Plaintiff”) claims he was seriously injured when the lithium-ion batteries for electronic cigarettes (“E-cigarettes”) he was carrying in his pocket suddenly exploded. Presently before the Court are Plaintiff’s motion to remand and for attorneys’ fees, and Defendants’ motion to dismiss for improper venue or to transfer the action to the Eastern District of Texas, Sherman Division.
