13 14 Before the court is defendant Ghirardelli Chocolate Company’s (“Ghirardelli” or 15 “defendant”) motion for partial summary judgment.1 The matter is fully briefed2 and 16 suitable for decision without oral argument. Having read the parties’ papers and carefully 17 considered their arguments and the relevant legal authority, and good cause appearing, 18 the court hereby rules as follows. 19 BACKGROUND 20 A broader discussion of the factual background may be found in the court’s April 8, 21 2020 order.
