INTRODUCTION Plaintiff-Realtor STF, LLC brings this qui tam action on behalf of the United States and the State of California against Defendants Crescendo Bioscience, Inc. and Myriad Genetics, Inc., under the Federal False Claims Act, California False Claims Act, and California Insurance Frauds Prevention Act. Before the Court is Defendants’ Motion to Dismiss STF’s First Amended Complaint (“MTD”), ECF No. 49, which seeks dismissal of STF’s claims pursuant to Federal Rules of Civil Procedure 9(b) and 12(b)(6). The Court finds this matter suitable for disposition without oral argument and VACATES the May 28, 2020 hearing. See Civ. L.R. 7-1(b).
