12 13 14 INTRODUCTION 15 Matthew Perez, an inmate at Salinas Valley State Prison, filed this pro se civil rights action 16 under 42 U.S.C. § 1983. This action is now before the court for consideration of the motion for 17 summary judgment filed by defendants Franco, Moore, Peffley, and Salgado. Perez opposes the 18 motion. For the reasons discussed below, summary judgment will be granted in the moving 19 defendants’ favor. 20 21 BACKGROUND 22 This action concerns prison officials’ efforts to obtain contraband that they saw Perez ingest 23 during a visit with his girlfriend.
