13 Defendants. 14 In this action under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. 15 Section 1132(a)(1)(B), (a)(2) and (a)(3), defendant California Physicians’ Service dba Blue Shield 16 of California (“Blue Shield”) brings a motion to dismiss (Dkt. No. 33) the second cause of action in 17 plaintiff Amy F.’s First Amended Complaint (“FAC”).1 Blue Shield argues that the second cause 18 of action for breach of fiduciary duty should be dismissed on several grounds: (1) lack of Article III 19 standing to pursue the relief sought; (2) failure to state a claim for relief under 29 U.S.C. § 20 1132(a)(2); and (3) failure to plead entitlement to equitable relief under 29 U.S.C. § 1132(a)(3). 21 The Court, having…
