13 Plaintiff Scott Johnson sues Defendant Montpelier One LLC, the owner of the real 14 property at 2380 Montpelier Drive, San Jose, California, alleging various barriers to accessibility 15 under the Americans with Disabilities Act (“ADA”) and California state law. Presently before the 16 Court is Defendant’s motion to dismiss the case pursuant to Federal Rule of Civil Procedure 17 12(b)(1).
