INTRODUCTION 10 This suit was reassigned from a magistrate judge to the undersigned in light of a recent 11 Ninth Circuit decision.1 Plaintiff, a state prisoner currently incarcerated at the California 12 Correctional Center and a frequent filer, has filed the instant pro se civil rights action pursuant to 13 42 U.S.C. § 1983 alleging constitutional violations at Salinas Valley State Prison (“SVSP”) where 14 he was previously incarcerated. He alleges that SVSP officials retaliated against him for filing 15 grievances by, among other things, using excessive force against him and depriving him of 16 necessary medical care. 17 Plaintiff has also moved for leave to proceed in forma pauperis (“IFP”) under 28 U.S.C. 18 § 1915.
