Defendant Montpelier One LLC was sued by Plaintiff Scott Johnson for failing to ensure the real property at 2380 Montpelier Drive, San Jose, California complied with the accessibility requirements imposed by the Americans with Disabilities Act (“ADA”) and California’s Unruh Civil Rights Act (“Unruh Act”). This is the Court’s second order regarding Defendant’s motion to dismiss the suit, which the Court has converted in part into a motion for summary judgment. See Dkt. No. 28.
