INTRODUCTION On April 16, 2020, Plaintiffs Spencer Verhines and Christopher James (collectively “Plaintiffs”) filed a Consolidated Class Action Complaint (“Consolidated Complaint”) alleging various wage-and-hour claims under California law and seeking various forms of relief, including under California’s Unfair Competition Law (“UCL”) and the federal Declaratory Judgment Act (“DJA”). See Docket No. 42. Defendant is Uber Technologies, Inc. (“Uber” or “Defendant”). Id. Uber now seeks dismissal of several parts of the Consolidated Complaint, principally Count I (Declaratory Judgment) and Count VI (UCL). See Docket No. 61. II.
