16 Elizabeth Belyea brings this putative class action against GreenSky of Georgia, LLC and GreenSky, LLC alleging violation of California’s consumer protection and lending and credit services laws. GreenSky’s motion to compel arbitration is now pending before the Court. After careful consideration of the parties’ briefing, including their Court-ordered supplemental briefs, and having had the benefit of oral argument on July 2, 2020, the Court DENIES the motion to compel arbitration without prejudice. GreenSky has failed to prove by a preponderance of the evidence that Plaintiff agreed to arbitrate.
