RELATOR’S MOTION TO STRIKE

Relator/Counter Defendant Thomas Grinner filed this case on March 9, 2020, alleging violations of the False Claims Act (“FCA”), 31 U.S.C. § 3729(a)(1), against Defendant/Counter Claimant Dana Ogden. [Docket No. 1.] Grinner filed an amended complaint on August 3, 2020. [Docket No. 25, First Amended Complaint (“FAC”).] On November 25, 2020, Ogden filed an answer and a counterclaim for breach of contract against Grinner. [Docket No. 43 (“Answer”).] Grinner now moves to strike Ogden’s affirmative defenses. [Docket No. (“MTD”), 52 (“Reply”).] Ogden opposes. [Docket No. 3 (“Opp.”)].
