10 On February 3, 2021, defendant Daybreak Metro, Inc. filed a motion to dismiss the amended complaint with a hearing set for March 12, 2021. Having considered the papers submitted, the Court hereby VACATES the March 12, 2021 hearing pursuant to local rule 7-1(b) and, for the reasons articulated below, DISMISSES the amended complaint with leave to amend. 15 BACKGROUND In November 2020, plaintiff filed a complaint seeking damages because defendant engaged in “illegal wrongful conversion" and “illegal wrongful repossession” of plaintiff’s 2011 black Cadillac Escalade.
