In 2020, Plaintiff Elijah Soto purchased a Onewheel+ XR single-wheeled electric skateboard (the “XR” or “Class Vehicle”) from the website of Defendant Future Motion, Inc. Dkt. 14 (First Amended Complaint, corrected at Dkt. 30 (“FAC”)) ¶ 22. Plaintiff brings this product defect action on behalf of a class of XR owners. Id. ¶¶ 1, 30. Defendant filed a motion to dismiss the FAC and a motion to strike the class allegations in the FAC. Dkt. 20, 23. After briefing on Defendant’s motions was complete, at the Court’s request, the parties filed an additional joint brief addressing whether the Court has subject matter jurisdiction over this case.
