12 I. INTRODUCTION Pending before the Court is Defendant Kohlberg Ventures, LLC’s (“Kohlberg Ventures”) Motion for Summary Judgment pursuant to Federal Rule of Civil Procedure 56. ECF No. 91. Plaintiff Peter Wojciechowski, on behalf of himself and a certified class (referred to here collectively as “Wojciechowski”), filed an Opposition, ECF No. 97, and Defendant filed a Reply. ECF No. 99. In his Complaint, ECF No. 1, Wojciechowski seeks to recover damages for alleged violations of the Worker Adjustment and Retraining Notification Act (the “WARN Act” or the “Act”), 29 U.S.C. §§ 2101–2109.
