Plaintiff Carol Lenzini brings this action against defendant DCM Services, LLC (“DCM”). Lenzini brings two claims for violations of the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692 et seq., and the Rosenthal Fair Debt Collection Practices Act (“Rosenthal Act”), Cal. Civ. Code § 1788 et seq. Now before the Court is DCM’s motion to dismiss the operative first amended complaint under Federal Rules 12(b)(1) and (b)(6). (Dkt. No. 26.) Lenzini opposes the motion. (Dkt. No. 25.) The matter was fully briefed by the parties. (Dkt.
