13 On April 23, 2021, the Court held a hearing on the parties’ cross-motions for summary judgment. After the hearing, the Court ordered supplemental briefing, and that briefing was submitted on May 11. For the reasons set forth below, the motions are GRANTED in part and DENIED in part. The Court sets a status conference for 11 a.m. on October 21, 2021, to discuss further proceedings in this case, including the appointment of a Special Master and scheduling of a bench trial. 20 DISCUSSION I.
