13 Plaintiffs prevailed at trial on their product liability and failure to recall claims against Chart Industries and judgment was entered in their favor on August 13, 2021. There are over 130 16 other consolidated related cases which are a part of the In re: Pacific Fertility Litigation. (Dkt. 17 No. 554.2) The next five cases are set for trial January 31, 2022. (Dkt. No. 620.) As part of their pre-trial filings, these Plaintiffs have moved for partial summary judgment seeking to bar Chart from relitigating the cause of the underlying incident on the grounds that the jury’s findings from the prior trial should be…
