12 This is an action brought against Google LLC (“Google”) for violation of the Illinois Biometric Information Privacy Act (“BIPA”) and unjust enrichment for its alleged use of IBM’s Diversity in Faces dataset, which allegedly contained Plaintiffs’ Flickr photographs. See Complaint, ECF No. 1. On February 12, 2021, the Court stayed this action pending the resolution of Vance v. International Business Machines, Corporation (“IBM Action”) before the U.S. District Court for the Northern District of Illinois, an earlier-filed action in which Plaintiffs brought BIPA and unjust enrichment claims against IBM for the alleged creation and dissemination of the Diversity in Faces dataset.
