12 Jamal X. Butler has filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Docket No. 6 (“Petition”). Currently pending before the Court is the State’s motion to dismiss based on the statute of limitations. Docket No. 13 (“Dismissal Motion”). Having considered the parties’ briefs and accompanying submissions, as well as all other evidence of record, the State’s motion to dismiss is GRANTED.1 I. FACTUAL & PROCEDURAL BACKGROUND In 2008, Mr. Butler was convicted in state court of second degree murder and being a felon in possession of a firearm, with an enhancement for personally discharging a firearm in the commission of a murder.
