I. INTRODUCTION Plaintiff Tabitha Miller brings the instant suit against her former employer Walmart Associates, Inc. and Walmart, Inc. (together, “Walmart”), as well as Walmart employee Emmy Rodriguez, a Front End Lead Manager and/or People Lead for Walmart, and unnamed DOES 1 through 50. Plaintiff first filed her suit in the Superior Court of the County of Contra Costa, alleging various causes of action, including claims of harassment in violation of the Fair Employment and Housing Act (FEHA) and intentional infliction of emotional distress, but Defendants removed the action to federal court on the basis of federal diversity.
