Plaintiff (and counter-defendant) IT Casino Solutions, LLC (“ITCS”) moves to strike or dismiss affirmative defenses and counterclaims asserted by defendants (and counter-claimants) Transient Path, LLC (“Transient Path”) and Thomas Calvin (collectively, “the defendants”). The underlying suit filed by ITCS alleges that Transient Path infringed upon two of its patents and that both defendants violated California’s Unfair Competition Law (“UCL”) by creating, advertising, and selling casino management software. ITCS’s motion is GRANTED in part and DENIED in part. The fifth and sixth affirmative defenses, along with the third and fourth counterclaims, may proceed as pleaded.
