INTRODUCTION Hartford Life and Accident Insurance Company (“Hartford”) filed the instant Complaint in Interpleader to resolve competing claims to a life insurance policy by Defendants Haili Kowalski and Marilyne Valois. Each Defendant has filed cross-claims against the other. See Dkt. 16, at 7–12; Dkt. 25 (“Kowalski Cross-Claim”), at 9–15. Valois now moves under Rule 12(b)(6) to dismiss Kowalski’s cross-claims and to strike a portion thereof.
