Truman Scholarship Foundation’s (“Foundation”) “Motion,” filed January 9, 2023, “to Dismiss Fourth Amended Complaint” (“FAC”). On January 23, 2023, plaintiff Brendan Schultz (“Schultz”) filed his “Response to Defendant’s Notice of Motion and Motion to Dismiss Fourth Amended Complaint,” to which the Foundation has replied. Having read and considered the parties’ respective written submissions, the Court rules as follows.1 BACKGROUND2 The Foundation is a federal agency that administers the Harry S.
