15 I. INTRODUCTION Plaintiff Stanford Health Care (“Stanford”) filed this diversity action against Defendants Trustmark Health Benefits, Inc. (“Trustmark”),1 and The Chefs’ Warehouse, Inc. (“TCW”). The full background has been described previously and need not be repeated at length here. See Dkt. 42 (“MTD Order”), at 2. In essence, Plaintiff avers it provided emergency medical services to “beneficiaries of a health insurance plan sponsored, administered and/or funded by Defendants,” (“the TCW Plan”), but that Defendants have failed to pay the full amounts billed by Plaintiff.
