INTRODUCTION This action involves plaintiff employee of a defendant senior living facility who alleges that a resident of that facility, also a defendant, sexually assaulted her. Plaintiff asserts fourteen claims based on California statutes and common law tort. Plaintiff and defendant employer have stipulated to binding arbitration, and plaintiff now moves to remand this action to state court. Because this district court lacks subject-matter jurisdiction over this action, plaintiff’s motion is GRANTED.
