Pending before this Court are Plaintiff’s motion for summary judgment (ECF No. 20) and Defendants’ cross motion for summary judgment (ECF No. 30). The Court heard the parties on June 1, 2023. For the reasons stated below, the Court DENIES Plaintiff’s motion and GRANTS in part Defendants’ cross motion. The Court also declines to exercise supplemental jurisdiction over Plaintiff’s state law claim and DISMISSES the state law claim for lack of jurisdiction without prejudice. I.
