12 On September 9, 2022, the Court dismissed this case without leave to amend pursuant to Section 1915(e) finding Plaintiff’s second amended complaint failed to state a claim upon which relief could be granted. (Dkt. No. 21.) On September 19, 2022, Plaintiff filed a motion for reconsideration of the Court’s order of dismissal pursuant to Federal Rule of Civil Procedure 59. (Dkt. No. 23.) On October 11, 2022, he filed a motion to reopen the case, again citing Rule 59. (Dkt. No. 24.) On March 7, 2023, Plaintiff filed a notice of appeal to the Ninth Circuit Court of Appeals. (Dkt. No. 25.) On March 16, 2023, the Ninth Circuit ordered the appellate proceedings held in abeyance pending the Court’s resolution of those motions. (Dkt. No. 29.)
