16 Defendant. 17 This action arises out of a contractual relationship between Nanometrics Incorporated 18 (“Nanometrics”),1 a manufacturer of semiconductor testing equipment, and Optical Solutions, Inc. 19 (“OSI”), a builder of optical lenses used in semiconductor testing equipment. Each party has an 20 operative complaint in this consolidated action; presently before the Court is Nanometrics’s 21 motion for summary judgment (the “Motion”) on OSI’s Fourth Amended Complaint, which 22 alleges claims for breach of contract and promissory estoppel.
