11 Tania T. Marker, representing herself, filed this action under the Freedom of Information 12 Act (“FOIA”), 5 U.S.C. § 552, and the Declaratory Judgment Act, 28 U.S.C. §§ 2201 and 2202, 13 alleging the U.S. Department of Education, the Secretary of Education, failed to comply with 14 FOIA requirements. The Court granted Ms. Marker’s application to proceed in forma pauperis, 15 (Dkt. No. 4)1, but dismissed her claim pursuant to 28 U.S.C. § 1915. (Dkt. No. 5.)
