12 13 Before the Court is Defendant Netflix, Inc.’s motion for summary judgment, ECF No. 162, 14 as well as Valjakka’s motion for leave to file supplemental briefing, ECF No. 244. The Court will 15 grant Netflix’s motion and deny Valjakka’s motion. 16 I. BACKGROUND 17 A. Factual Background 18 This action centers on United States Patent No. 8,495,167 (“’167 Patent”) and the 19 underlying Patent Application No. 10/208,685 (“’685 Application”) filed on July 30, 2002. ECF 20 No. 74 ¶ 12; ECF No. 162-2.
