11 Defendant United States moves to dismiss portions of Plaintiff Florie Johnson’s complaint 12 pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6). [Docket No. 16.] This matter 13 is suitable for resolution without a hearing. Civ. L.R. 7-1(b). For the following reasons, the 14 motion is granted. 15 I. BACKGROUND 16 A. Factual Background 17 Johnson is a 62-year-old African American woman. Since 2018, she has received primary 18 care medical treatment at the University of California, San Francisco Medical Center (“UCSF”), 19 which is operated by the Regents of the University of California (“UC Regents”). She also 20 receives medical services from the United States Department of Veterans Affairs (“VA”). Compl. 21 ¶¶ 2, 14. Johnson is a cancer survivor and has a history of “painful podiatry issues that…
