13 Defendants Google LLC and Alphabet Inc. (collectively, “Google”) move to compel 14 arbitration. The motion comes four years into this litigation, after the parties have engaged in 15 substantial motion practice, after completion of fact and expert discovery, and after the Court has 16 certified a class. Plaintiffs contend that Google waived its right to compel arbitration. The Court 17 finds that Plaintiffs have established waiver, and on that basis Google’s motion is DENIED. 18 I. BACKGROUND 19 This consumer class action comprises three cases that were consolidated by the Court. See 20 Compl., ECF 1; Order, ECF 42; Order, ECF 109.
