12 13 Before the Court is Plaintiff Peyman Roshan’s motion for preliminary injunction, ECF No. 14 17, and Defendant Commissioner Douglas R. McCauley’s motion to dismiss, ECF No. 28. For 15 the reasons stated below, the Court will deny Roshan’s motion for preliminary injunction, and 16 grant Commissioner McCauley’s motion to dismiss.1 17 I. BACKGROUND 18 For the purpose of resolving the present motions, the Court accepts as true the following 19 factual allegations from the complaint, ECF No. 1. 20 Roshan alleges that he “has obtained a license from the California Department of Real 21 Estate (“DRE”),” and “is an attorney admitted to practice in California.” Id. ¶ 2.
