12 Before the Court is Plaintiff Peyman Roshan’s motion for preliminary injunction, ECF No. 17, and Defendant Commissioner Douglas R. McCauley’s motion to dismiss, ECF No. 28. For the reasons stated below, the Court will deny Roshan’s motion for preliminary injunction, and grant Commissioner McCauley’s motion to dismiss.1 I. BACKGROUND For the purpose of resolving the present motions, the Court accepts as true the following factual allegations from the complaint, ECF No. 1. Roshan alleges that he “has obtained a license from the California Department of Real Estate (“DRE”),” and “is an attorney admitted to practice in California.” Id. ¶ 2.
