On behalf of a putative class of California 19 consumers, the plaintiff challenges defendant Rust-Oleum’s labeling of its “Krud Kutter” cleaning 20 products as “non-toxic” and “Earth friendly,” contending that the products in fact can cause harm 21 to humans, animals, and the environment, in violation of California consumer-protection laws. 22 The plaintiff now moves for class certification under Federal Rule of Civil Procedure 23.
