Minglana 16 was deliberately indifferent to his safety, in violation of the Eighth Amendment. ECF Nos. 1, 13. 17 Defendant Minglana has filed a motion to dismiss the complaint, ECF No. 22; Plaintiff has filed 18 an opposition, ECF No. 26, and Defendant has filed a reply, ECF No. 27.
