12 Before the Court is Defendant RLI Insurance Company’s motion to dismiss. Plaintiffs Orestes Cross and Veronica O’Neill oppose the motion. Having considered the parties’ papers, the relevant legal authority, and the arguments advanced by counsel during the hearing held on February 1, 2024, the Court GRANTS the motion WITHOUT LEAVE TO AMEND, for the reasons set forth below. I. BACKGROUND A. Factual Background1 This insurance coverage dispute arises from RLI’s alleged failure to provide Plaintiffs underinsured motorist coverage in connection with a 2017 car accident.
