12 13 On December 4, 2023, the Federal Circuit reversed a Texas district court’s denial of Intel 14 Corporation’s (“Intel”) motion for leave to amend its answer to add a defense that it is licensed to 15 use VLSI Technology LLC’s (“VLSI”) patents. VLSI Tech. LLC v. Intel Corp., 87 F.4th 1332, 16 1351 (Fed. Cir. 2023). Before the Court is a motion for leave to amend involving the same parties 17 and the same license in a separate case. Intel has filed a Motion for Leave to File a Second 18 Amended Answer, Defenses, and Counterclaims. ECF No. 809 (“Mot.”); ECF No. 827 19 (“Reply”).
