12 13 Pending before the Court are three discovery dispute joint letters. The Court heard oral 14 argument on February 15, 2024. 15 A. Dkt. No. 49 (Temporal Scope) 16 For the reasons stated at the hearing, the Court grants the government’s motion to compel. 17 Assuming the truth of the complaint’s allegations, the sought-after communications are relevant to 18 a claim or defense in this action and proportional to the case’s needs. 19 B. Dkt. No. 48 (Butterfield Bank) 20 The government’s motion to compel is denied. The government’s submission makes no 21 effort to establish Mr. Galliani has “possession, custody, or control” as required by Federal Rules 22 of Civil Procedure 34(a)(1)(A). See United States v.
