The patent is U.S. Patent No. 11,078,007 (the ’007 patent). The parties are 22 competitors.1 Cellulose’s insulation product is called InfinityCore, and Thermal Shipping’s product 23 is called Renewliner.2 Thermal Shipping moved for summary judgment of invalidity on two 24 grounds: that an offer by Cellulose to Thermal Shipping to sell a prototype of the invention, before 25
