17 18 Plaintiff, a state prisoner, filed the instant pro se civil rights action pursuant to 42 19 U.S.C. § 1983 against prison staff at San Quentin State Prison (“SQSP”), where he is 20 currently confined. Dkt. No. 6. Plaintiff filed a motion for leave to proceed in forma 21 pauperis which will be addressed in a separate order. 22 23 DISCUSSION 24 A. Standard of Review 25 A federal court must conduct a preliminary screening in any case in which a 26 prisoner seeks redress from a governmental entity or officer or employee of a 27 governmental entity.
