13 14 This patent infringement action involves two manufacturers of telescoping poles used to 15 clean swimming pools. Defendants Robert Conrad, Inc. d/b/a/ Skimlite Manufacturing (“RCI”), 16 James Conrad (“Conrad Sr.”), and Barrett Conrad (“Conrad Jr.”) (collectively, “Defendants”) 17 move to dismiss the First Amended Complaint (“FAC”) on Rule 8, 12(b)(6), and 12(b)(3) 18 grounds, as well as to strike certain allegations under Rule 12(f). Motion to Dismiss (“Mot.”), 19 ECF No. 77. Defendants also seek permission to file a motion to recover attorneys’ fees incurred 20 in preparing the motion.
