12 13 Before the Court is Defendants County of Napa and Jacqueline Flores’s motion to dismiss. 14 The matter is fully briefed and suitable for decision without oral argument. See Civil L.R. 7-6. 15 Having read the parties’ papers and carefully considered their arguments and the relevant legal 16 authority, and good cause appearing, the Court hereby GRANTS the motion to dismiss, for the 17 following reasons. 18 I. BACKGROUND 19 This case challenges the mask mandate at a Napa public library. On January 11, 2022, 20 Plaintiff Jeffery Thomas Smith, pro se, used the Napa County Library in Calistoga, California, 21 without a face mask.
