12 13 Now before the Court for consideration is the motion to dismiss or to stay filed by 14 Defendant Lenovo (United States), Inc. (“Lenovo”).1 The Court has considered the parties’ 15 papers, relevant legal authority, and the record in this case, and for the reasons that follow, the 16 Court GRANTS, IN PART, AND DENIES, IN PART, Lenovo’s motion. 17 BACKGROUND 18 A. The Instant Litigation. 19 Plaintiffs Mark Hermanson, Chun-Yu Chen, and Shuang Lin (collectively “Plaintiffs”) 20 filed the complaint in this case on November 14, 2023.
