12 13 Before the Court is the parties’ Joint Discovery Letter Brief. ECF No. 99. Lead Plaintiff 14 Indiana Public Retirement System seeks an order authorizing it to provide the U.S. Food and Drug 15 Administration (FDA) with deposition exhibits and testimony marked as confidential pursuant to 16 the Protective Order governing this case (ECF No. 69) by Defendants ChemoCentryx, Inc. 17 (ChemoCentryx), and Thomas J. Schall, President and CEO of ChemoCentryx. Id. at 1.1 Lead 18 Plaintiff contends that this disclosure and use of the material is necessary to allow the FDA to 19 provide testimony by affidavit or sworn declaration. Id.
